XIO E-Commerce Terms of Service
Article 1 (Purpose)
These Terms of Service (the “Terms”) govern the rights, obligations, and responsibilities of XIO (hereinafter referred to as the "Company") and users concerning the use of internet-related services (the "Services") provided by the XIO online store (the "Store"). These Terms also apply to electronic transactions conducted through PC communication systems unless otherwise stated.
Article 2 (Definitions)
- "Store" refers to the virtual business platform established by XIO to provide goods and services to users through computers or other telecommunication devices. It may also refer to the business entity that operates the online store.
- "User" refers to both members and non-members who access the Store and use the Services provided under these Terms.
- "Member" refers to a user who has provided personal information to register as a member and continues to receive information from the Store while using its Services.
- "Non-Member" refers to a user who uses the Store's Services without registering as a member.
Article 3 (Notification and Amendment of Terms)
- The Store shall post these Terms, the Company’s trade name, business location, representative’s name, business registration number, contact details (telephone, email, etc.), and other necessary information on the Store's homepage.
- The Store may amend these Terms within the scope permitted by relevant laws, including:
- The Act on the Regulation of Terms and Conditions
- The Framework Act on Electronic Transactions
- The Digital Signature Act
- The Act on Promotion of Information and Communications Network Utilization
- The Act on Consumer Protection, and other applicable laws.
- When amending these Terms, the Store shall specify the effective date and reason for the amendment and post the changes on the Store’s homepage at least seven (7) days before they take effect.
- Changes to the Terms apply only to contracts entered into after the effective date, while existing contracts remain subject to the previous Terms. However, if an existing user wishes to adopt the amended Terms, they may notify the Store within the amendment notification period and obtain the Store’s approval.
- Matters not specified in these Terms shall be governed by the Electronic Commerce Consumer Protection Guidelines and other applicable laws or customary business practices.
Article 4 (Provision and Modification of Services)
- The Store provides the following services:
- Information on goods or services and facilitation of purchase agreements.
- Delivery of purchased goods or services.
- Other tasks designated by the Store.
- If a product is out of stock or specifications change, the Store may modify the goods or services provided under future contracts. In such cases, the Store will notify users by posting changes at least seven (7) days in advance.
- If the Store modifies an existing contract due to product shortages or technical specification changes, it shall compensate users for any damages incurred unless the Store is not at fault.
Article 5 (Service Suspension)
- The Store may temporarily suspend Services due to maintenance, replacement, or malfunction of computer and telecommunication systems.
- In such cases, the Store shall notify users in accordance with Article 8.
- The Store shall compensate users or third parties for damages caused by temporary service suspensions unless the Store is not at fault.
Article 6 (Membership Registration)
- Users may apply for membership by completing the Store’s registration form and agreeing to these Terms.
- The Store shall approve membership applications unless:
- The applicant has previously lost membership under Article 7, Clause 3 (exceptions apply if at least three (3) years have passed and the Store has approved re-registration).
- False information, omissions, or errors are found in the registration details.
- Technical reasons make membership registration infeasible.
- Membership is established when the Store’s approval is received by the applicant.
- Members must promptly notify the Store of any changes to their registered information.
Article 7 (Membership Termination and Disqualification)
- Members may request membership termination at any time, and the Store shall process such requests promptly.
- The Store may restrict or suspend membership if a member:
- Provided false information at registration.
- Fails to pay for goods or services purchased through the Store.
- Disrupts the Store’s operations or commits fraudulent activities.
- Engages in unlawful activities or violates public morals.
- If the same violation is repeated or not corrected within thirty (30) days, the Store may permanently revoke membership.
- In the event of membership termination, the Store shall notify the member and provide an opportunity to appeal before finalizing the decision.
Article 8 (User Notifications)
- The Store may notify members via the registered email address.
- General notifications for multiple members may be posted on the Store’s bulletin board for at least one (1) week instead of individual emails.
Article 9 (Purchase Requests)
Users may request purchases through the following process:
- Enter name, address, and contact information.
- Select goods or services.
- Choose a payment method.
- Agree to the Terms (e.g., clicking a confirmation button).
Article 10 (Contract Formation)
- The Store may decline purchase requests if:
- False, omitted, or erroneous information is provided.
- A minor attempts to purchase restricted items (e.g., alcohol, tobacco).
- Accepting the purchase request would pose significant technical challenges.
- The purchase contract is concluded when the Store sends a confirmation notice to the user.
Article 11 (Payment Methods)
Users may pay for goods or services using the following methods:
- Bank transfer
- Credit card
- Online direct deposit
- Electronic money
- Cash on delivery
Article 13 (Shipping and Delivery)
The Store shall specify shipping methods, costs, and estimated delivery times. If the Store fails to meet the agreed delivery time due to its own fault, it shall compensate users for resulting damages.
Article 14 (Refunds, Returns, and Exchanges)
- If the Store cannot fulfill an order due to stock shortages or other reasons, it shall notify the user and issue a refund within three (3) days.
- The Store shall accept returns, exchanges, or refunds under the following conditions (requests must be made within twenty (20) days of delivery):
- The delivered item differs from the order.
- The item is defective or damaged.
- Delivery was delayed beyond the advertised period.
Article 15 (Privacy Protection)
The Store collects and protects user information in compliance with applicable privacy laws, including GDPR and CCPA where applicable.
Article 22 (Governing Law and Jurisdiction)
- Disputes arising from electronic transactions shall be subject to the jurisdiction of the court specified under civil procedure laws.
- Korean law shall govern electronic transactions between the Store and users.
Article 23 (Changes to E-Commerce Terms of Service)
This E-Commerce Terms of Service effect from the implementation date. Any changes will be announced at least seven days before implementation.
